1. Acceptance of Terms

By downloading, installing, or using the Pronouncy app (“the App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Service Description

Pronouncy is a speech coaching app for iOS that helps you:

  • Practice pacing and filler word detection
  • Rehearse with a speech-tracked Smart Prompter
  • Train by reading aloud with Training Mode
  • Practice flashcards by speaking answers
  • Track analytics (pace trends, filler frequency, streaks, transcripts)
  • Generate practice prompts with on-device ML (Pro)

The App is designed as a personal speech coaching tool. Speech analysis and feedback are provided for practice purposes and are not a substitute for professional speech therapy or medical advice.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent. The App does not collect personal data from any user, regardless of age.

4. User Data and Privacy

Pronouncy stores all data locally on your device using SwiftData. We do not create user accounts, collect personal information, or transmit data to external servers. Optional iCloud sync goes directly to your personal iCloud account. For complete details, please read our Privacy Policy.

5. Purchases and Payments

Pronouncy offers an optional one-time Pro upgrade:

  • Pro upgrade: €9.99 (one-time purchase)

Purchases are processed exclusively through Apple’s App Store using StoreKit 2. By purchasing, you also agree to Apple’s Terms and Conditions.

  • The free tier includes all core speech coaching features forever
  • The Pro upgrade is a one-time purchase that unlocks AI-generated practice prompts
  • Refunds are handled by Apple per their refund policies

6. Intellectual Property

The App, including its design, code, content, icons, and branding, is protected by copyright and intellectual property laws. You may not:

  • Copy, modify, or distribute the App’s source code
  • Reverse-engineer, decompile, or disassemble the App
  • Use the Pronouncy name, logo, or branding without written permission
  • Create derivative works based on the App

7. Your Content

All data you enter into the App (transcripts, flashcard content, session data, and statistics) remains your property. We do not claim any ownership or rights to your data. You are responsible for the accuracy and legality of the information you enter.

8. Acceptable Use

You agree to use the App only for its intended purpose of speech coaching and practice. You may not:

  • Use the App for illegal activities
  • Attempt to compromise the App’s security or functionality
  • Use automated systems to interact with the App
  • Redistribute the App outside of the App Store

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that:

  • The App will be error-free or uninterrupted
  • Speech recognition and analysis are 100% accurate
  • Filler word detection captures every instance
  • The App will meet all your specific requirements
  • Data will not be lost due to device failure

Pronouncy is not a substitute for professional speech therapy. If you have a speech disorder or medical condition, please consult a qualified speech-language pathologist.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

  • Inaccurate speech analysis or feedback
  • Data loss due to device failure or software issues
  • Interruption of App availability

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to discontinue the App or any features at any time.

12. Changes to Terms

We may update these Terms of Use from time to time. Changes will be indicated by updating the “Last updated” date. Continued use of the App after changes constitutes acceptance of the new terms. For significant changes, we will provide notice through App Store release notes.

13. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these terms or the use of the App shall be subject to the jurisdiction of the courts in Germany. If you are a consumer within the European Union, you also have the right to bring proceedings in the courts of your country of residence.
